If the employee has been off sick for a period of two years, you may apply to UWV for a dismissal permit. Alternatively, in consultation with the employee, the employment contract can be terminated. We can advise and guide you, and carry out the procedure.
The first choice to be made is between a temporary and a permanent employment contract. Next, matters like probationary period, employment terms and conditions and other agreements must be decided and recorded in writing. The relevant legislation and regulations change all the time. Schuiteman will ensure that the employment contract is legally correct.
Untaxed allowances, benefits and availabilities are now arranged under the Work-Related Expenses Scheme (Dutch: werkkostenregeling, WKR). In any event, based on the payroll total, a small amount (1.2%) can be paid tax free. This is also called the tax-free margin. Depending on the type of provision and its nature, it is also possible to make tax-free provisions that fall outside the tax-free margin of the Work-Related Expenses Scheme.
